Labor Certification

Each application for an employment visa must be accompanied by a labor certification request (Form ETA 750), submitted to the Department of Labor, not USCIS. This form documents that no other qualified American workers are available to fill the position. If the labor certification request is improperly completed or lacks needed information, it will be returned. This will delay the approval of the employer's Form ETA 750 and visa request.

Permanent Labor Certification Final Rule

The Permanent Labor Certification Final Rule (known as PERM), published in December 2004, allows for electronic filing as well as submission by mail. It also eliminates the need to submit the supporting documentation with the labor certification request.
